Electronic Statement Agreement and Disclosure Statement

Introduction and Registration
By signing and returning an application and enrollment form (the “Application”) to subscribe for electronic statements offered by Rayne State Bank & Trust Company (the “Bank”) as described in this Electronic Statement Agreement and Disclosure Statement (this “Agreement”) and as otherwise made available by the Bank from time to time (“Electronic Statements”), you, and any person authorized by you to use the Electronic Statement Service agree to the terms and conditions of this Agreement, as it may be amended from time to time.

Each time you use the Electronic Statement Service constitutes confirmation by you of your agreement to and understanding of the terms of this Agreement and any information on screens that may appear on your computer when you open the email attachment. This Agreement will be effective as of the date of our acceptance of this Agreement and as evidenced by our issuance of a prenote sent to the email address provided in the application. Please read this Agreement carefully and keep it for future reference.

Eligibility
In order to utilize the Bank’s Electronic Statement Service, you must have one or more deposit accounts with the Bank. You will also have the option to consolidate all of your accounts held at the Bank allowing one email to be sent each month containing updated account information on all accounts you have included in the consolidation. In this event, the primary account must be a checking account which cycles monthly, allowing you to get the most updated information available.

Definitions
Each reference in this Agreement to the “Bank”, “we”, “us”, or “our” refers to Rayne State Bank & Trust Company, a Louisiana banking corporation, as well as any agent, independent contractor, service provider, designee, or assignee the Bank may involve in the provision of the Electronic Statement Service.“Service” refers to an emailed periodic statement, change in terms notice and/or related disclosures for your accounts held with the Bank.

Each reference to “you” or “your” refers to each depositor, borrower, authorized signer, or authorized user for an account who is now or hereafter enrolled to receive electronic statements with respect to the account(s).

Each reference to “E-statements” refers to Electronic Statements.

Each reference to “email address” refers to electronic address.

Business Days. Our business days are Monday through Friday. Holidays are not included. You may contact the bank during the hours of 8:00 a.m. to 5:00 p.m. by calling the number listed at the top of this Agreement with any changes and/or questions.

Privacy Statement. Rayne State Bank & Trust Company understands how important privacy is to you, our customer. We have made sure that the security and privacy of your personal and financial dealings have been taken care of. Your E-statements contain a security layer that supports 128-bit key encryption. Our privacy statement (which has been previously provided to you) is available at all branch locations and can be reviewed by clicking on the following link – Privacy Statement on our internet website, www.bankonnet.com.

Our Requirements. First, the same terms apply with respect to electronically delivered Bank statements as for those delivered in paper form, and the deposit agreements and disclosures that you have previously entered into with or received from the Bank remain in effect.

Second, for you to be able to receive and view your E-statements effectively, you must have access to a personal computer (a “PC”) with a modem and related equipment (the “Hardware”). You also must provide the type of telephone service and Internet access service required by the Hardware and/or the software, as well as an Internet browser that supports 128-bit encryption, such as Netscape Navigator version 4.7 or Internet Explorer version 5.0 or above, and Adobe Acrobat Reader 7.0 or greater. Adobe Acrobat Reader is available for free at http://www.adobe.com. Once the Hardware has been properly connected to the telephone service, and any required Internet access has been established, you will be able to open your E-statement attachment using your password as described below. You are and will remain solely responsible for the purchase, hook-up, installation, loading, operations and maintenance of the Hardware, the software, the telephone service, and the Internet service to your personal computer, and for all related costs. You are solely responsible for scanning the Hardware and the software for computer viruses and other related problems before you use them.

Consent. In order for the Bank to begin forwarding your Bank Statements to you electronically, we need your consent. If your account is a joint account, any one of the joint accountholders may consent to receive E-statements and other disclosures electronically and that person’s consent will apply to all joint accountholders. You must read the Agreement entirely and then complete the Electronic Statement Application. You may obtain these two documents either by mail, at one of our branches, or by clicking the agree button (online version of this Agreement) and printing the Application and Agreement from your computer. By agreeing to have your Bank Statements sent electronically, you also agree to notify Rayne State Bank immediately of any change in your email address or any errors or complications relating to your electronic receipt or access of your E-statements. This can be done by contacting us at the addresses and/or numbers listed in the heading of this Agreement.

Email Address; Verification of Address. Shortly after we receive your Electronic Statement Application, the Bank will send you a prenote in the form of a “test” email to the email address provided on the Application. This email will welcome you to the Electronic Statement Service, and provide you with the initial password combination you will need to open the emailed attachment containing your E statement. The Electronic Statement Service will not be activated until a reply is received confirming that the email address is valid and capable of receiving information from our Bank. In the event that the “test” email is returned to the Bank undelivered, the Bank will take reasonable steps to attempt redelivery using information in the Bank’s customer information files. Any changes in your email address must be received in writing with your signature and date. For your convenience, a blank change of address form can be found on the Bank’s website at www.bankonnet.com. This form must be completed, signed and returned to the Bank at the address or fax number located in the heading of this Agreement.

Password; Confidentiality of Password. The first time you open the attachment containing your Estatement, you will be required to input the password that will be provided to you in your “test” email. A password will be required each time you open the file, even if you have saved the file to your personal computer. You may change your password from time to time by contacting the Bank at the addresses and/or numbers listed in the heading of this Agreement. You must, however, receive at least one Estatement using the initial password before you are able to request a change in your password. We recommend that you do not use your social security number, birth date, name, or other codes that may be easy for others to identify as your password. You should never provide your password to anyone unless you intend to allow that person access to your account information. It is important that you keep your password confidential. We will not be liable for any losses resulting from your permitting other person(s) to use your password to access your E-statement.

Periodic Statements and Disclosures. By signing a paper copy of the Electronic Statement Agreement and providing it to Rayne State Bank, you are giving the Bank your consent to electronically forward to you your periodic account statements and any other disclosures that the Bank might send to you with your account statements, such as Truth in Lending disclosures or other required disclosures relating to your accounts for those accounts to which your consent applies. Upon receipt of your initial password combination from Rayne State Bank and your emailed attachment, you will be able to input your password and view your E-statement. The Bank recommends that you choose to either print your statement and/or save the statement to your personal computer for future reference. 

If you elect to receive your account statements through electronic delivery, the Bank will no longer send your statements through the mail. If however, the email address provided fails after two attempts, then the e-statement will be deemed undeliverable and a paper statement will be mailed and appropriate fees charged until notified otherwise. You may request a paper copy of your statement by contacting us at the addresses and/or numbers listed in the heading of this Agreement. You will be charged a fee of $2.00 for each paper statement you request.

Delivery Timing of Statements and Notices. All emails from the Bank will be effective when we have sent them to your last known email address we have on record. Return replies from you will be effective when received by us at the email address noted in the heading of this Agreement. We will email you notice at least thirty (30) days before the effective date of any change when required by law to do so. Your use of the Electronic Statement Service is subject to existing laws and regulations covering your designated accounts and any future changes will be guided by those laws and regulations.

Termination. You may terminate the use of the Electronic Statement Service by notifying the Bank in writing, by email, fax, or personal delivery to the Bank. You will begin receiving paper statements starting with your next statement cycle. If your account(s) are closed for any reason, the Electronic Statements service will be terminated automatically. There will be no charge for canceling this service. We may also elect to discontinue providing the Electronic Statement Service to you without providing prior notice.

Errors and Adjustments. In case of errors or questions about your statement, telephone us at (337) 334-3191 or (337)235-2062, email us at rsbstmt@bankonnet.com, or write us at P.O. Box 129, Rayne, LA 70578-0129 as soon as you can, if you think your statement is wrong or if you need more information about the transactions listed on the statement.

Account Reconciliation. The deposit account E-statements or other notices provided to you by us will notify you of any amounts debited by the Bank from your primary account or any other account for the payment of charges assessed pursuant to this Agreement. YOU AGREE TO PROMPTLY EXAMINE EACH DEPOSIT ACCOUNT STATEMENT AND TO PROMPTLY REPORT ANY DISCREPANCIES BETWEEN YOUR RECORDS AND THE DEPOSIT ACCOUNT STATEMENTS OR ANY OTHER NOTICES THAT THE BANK PROVIDES TO YOU.

Other Agreements; Governing Law. The terms and conditions of the Agreement are cumulative with and in addition to any terms of the signature cards or agreements for your Deposit Account(s), the applicable Account disclosures, the Service Schedule, the Schedule of Funds Availability, the Bank’s Electronic Fund Transfer Agreement and Disclosure Statement, the agreements governing the Credit Accounts, the E-Sign Act, and the Application, all as may be amended from time to time. This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to Louisiana conflict of law provisions.

Fees. Our Electronic Statement Service is available to our customers free of charge.

Amendments. We may amend this agreement from time to time and will provide any required notice in accordance with applicable federal and state laws. Notwithstanding the foregoing and to the extent permitted by applicable law, we may change any term of this Agreement without prior notice or obligation to you: (a) if Software or the service provider changes any term without providing us sufficient notice to enable us to properly notify you; (b) for security reasons; (c) to comply with applicable law; (d) as otherwise expressly provided in this Agreement.

No Third-Party Beneficiaries. This Agreement is for the benefit of you and the Bank and is not intended to grant, and shall not be construed as granting,any rights to or otherwise benefiting any other person, except as expressly otherwise provided in this Agreement.
